Terms of Service

Agreement to Terms

By accessing or using BarbeloAI, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access or use the service.

Subscription and Payments

BarbeloAI offers subscription-based services. Your payment method will be charged according to the plan, setup fee, billing cycle, and pricing shown at the time of purchase.

You are responsible for all charges incurred under your account. We may use Stripe or another secure payment processor for payment processing, and we do not store your full credit card information on our servers.

Subscription fees, setup fees, SMS credits, and other service fees are non-refundable unless required by law. You may cancel your subscription at any time, and you will continue to have access to the service through the end of your billing period.

All pricing is subject to change at any time at the sole discretion of BarbeloAI. Continued use of the service following any pricing change constitutes acceptance of the updated pricing. AI agent accounts, wallet programs, SMS usage, automation usage, or other high-volume features may be subject to additional usage-based charges.

Account Registration

You must register for an account to use BarbeloAI. You agree to provide accurate and complete information and to keep your account information updated.

You are responsible for maintaining the security of your account, password, connected services, API keys, wallet credentials, and any third-party integrations connected to your account.

User Conduct

You agree not to use BarbeloAI for any illegal, harmful, abusive, or unauthorized purpose, including but not limited to:

Fraud, phishing, impersonation, or deceptive practices
Distributing malware or harmful content
Violating intellectual property rights
Harassing, abusive, threatening, or harmful communications
Interfering with the operation or security of the service
Collecting personal data from others without proper consent
Violating data protection laws, including GDPR, CCPA, or other applicable privacy laws
Sending spam, unlawful SMS messages, or messages without required consent
Using the platform to mislead customers, drivers, employees, or business contacts

Data Protection Responsibilities

If you use BarbeloAI to collect, store, send, or process personal data from your customers, employees, drivers, visitors, or end users, you acknowledge that:

You are responsible for obtaining all required consents from your users.
You are responsible for the accuracy and legality of the data you collect.
You will comply with applicable data protection laws, including GDPR, CCPA, CAN-SPAM, TCPA, and other relevant privacy or communication laws.
You will respond to data access, deletion, correction, and opt-out requests in a timely manner.
You are responsible for how you use wallet passes, SMS messages, AI agents, automations, QR codes, forms, and connected integrations.

Intellectual Property

BarbeloAI and its content, features, software, designs, workflows, automations, branding, platform tools, and functionality are owned by BarbeloAI or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

You may not copy, reproduce, reverse engineer, resell, or misuse any part of the service except as permitted by these Terms or with written permission from BarbeloAI.

User Content

You retain ownership of any content you create, upload, or share through BarbeloAI, including business information, customer data, wallet pass content, agent prompts, images, documents, and connected data.

By providing content to BarbeloAI, you grant us a worldwide, non-exclusive, royalty-free license to use, process, host, reproduce, modify, display, and distribute your content only as necessary to operate, provide, secure, and improve the service for you and your users.

Third-Party Services and Integrations

BarbeloAI may connect with third-party services such as Google, Stripe, Twilio, Apple Wallet, Google Wallet, OpenAI, Anthropic, Google AI, and other providers.

Your use of third-party services may be subject to their own terms, fees, privacy policies, and usage limits. BarbeloAI is not responsible for outages, policy changes, fees, errors, rejected messages, declined payments, or service limitations caused by third-party providers.

Termination

We may terminate or suspend your account and access to the service without prior notice or liability if you violate these Terms, misuse the service, create security risk, fail to pay required fees, or use the service in a way that may harm BarbeloAI, its users, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings, if available. Upon account deletion, we will delete or anonymize your personal data in accordance with our Privacy Policy and applicable law.

Limitation of Liability

To the maximum extent permitted by law, BarbeloAI, its owners, officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or lost-profit damages arising out of or relating to your use of, or inability to use, the service.

BarbeloAI does not guarantee that messages, wallet updates, automations, AI responses, bookings, QR codes, integrations, or notifications will always be delivered, accurate, uninterrupted, or error-free.

Indemnification

You agree to indemnify and hold harmless BarbeloAI, its owners, officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the service, your violation of these Terms, your violation of law, or your misuse of customer or user data.

Changes to Terms

We reserve the right to modify these Terms at any time. We may provide notice of significant changes by email, account notification, or by posting the updated Terms on our website with a new “Last updated” date.

Your continued use of the service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by the laws of the United States and the State of Texas, without regard to conflict of law provisions.

Google API Data Usage

When you connect a Google account, including Google Calendar, Google Sheets, Google Docs, or Google Drive, BarbeloAI handles data received from Google APIs in compliance with the Google API Services User Data Policy and its Limited Use requirements.

We do not use Google User Data to train generalized AI models, do not sell Google User Data, and do not transfer Google User Data to advertisers.

When an agent uses a Google feature you enabled, the content it reads is sent only to the AI provider you selected for that agent, using your own API key, to produce the response you asked for. See our Limited Use Disclosure and Privacy Policy for more information.

Platform SMS Usage

BarbeloAI may provide SMS messaging capabilities using platform phone numbers or connected customer-owned Twilio credentials.

Text messages that BarbeloAI customers send through the platform are sent by those customers, under their own consent and registrations. BarbeloAI's own text messaging program is described separately under Text Messaging Program below.

Each account may receive a limited number of included platform SMS messages depending on the selected plan. Once included messages are exhausted, additional SMS credits or usage charges may apply.

SMS credits are non-refundable. Free or included monthly credits may reset at the beginning of each calendar month and unused free credits may not roll over.

Users who connect their own Twilio credentials and phone numbers are responsible for their own Twilio charges, carrier compliance, message consent, opt-out handling, and applicable SMS regulations.

SMS is provided on a best-effort basis, and BarbeloAI does not guarantee message delivery. Standard carrier messaging rates may apply to recipients.

Text Messaging Program

BarbeloAI, operated by JAFEAR.COM LLC, offers a text messaging program (“BarbeloAI Text Updates”). By signing up through a BarbeloAI form, or by texting us, you agree to receive text messages at the mobile number you provide.

Message types: messages may include account notices, appointment and order updates, and customer support replies. We do not send third-party marketing.

Message frequency: message frequency varies, up to 4 messages per month.

Message and data rates may apply.

Opt out: you can cancel at any time by replying STOP. After you reply STOP, we will send one confirmation message and you will receive no further messages. To rejoin, reply START or sign up again.

Consent to receive text messages is not a condition of any purchase.

Mobile carriers and their affiliates are not liable for delayed or undelivered messages.

Our Privacy Policy explains how we collect, use, and protect the information you give us, including your mobile number.

BarbeloAI Text Updates is BarbeloAI's own messaging program for our own services. It is separate from the SMS features that BarbeloAI customers use to message their own contacts under their own registrations and consent. We do not use this program for third-party marketing, lead generation, or affiliate marketing, and we do not sell or rent mobile numbers.

Dispute Resolution

Any disputes arising from these Terms or your use of the service will first be attempted to be resolved through good-faith negotiation.

If a resolution cannot be reached, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise required by applicable law.
